Limited Warranty
- All MJS-Series Computers
(a) 2 Year
Limited Parts Warranty. MJS Computer Services, LLC warrants that the MJS-Series
will be free from defects in materials and workmanship for a period of two (2)
years from date of invoice. Only system components sold on the original invoice
by MJS Computer Services, LLC are covered under the Limited Warranty. Third party
products on the invoice (including, but not limited to, monitors, printers,
scanners, surge suppressors, UPS products, any custom ordered product and any
other non-internal components) are covered by the warranty of the respective
manufacturer. Please consult the warranty documentation that accompanies the
respective products. Software is not included in the MJS Computer Services, LLC
warranty.
(b) 2 Year
Limited Labor Warranty. MJS Computer Services, LLC, at its sole discretion, will
replace any defective MJS-Series product covered under the 2 Year Limited Parts
Warranty at no additional charge for a term of ninety (90) days. The product
must be shipped freight prepaid to MJS Computer Services, LLC for replacement.
Product failures related to software are not covered by the MJS Computer
Services, LLC limited warranty.
(c) Limited
MJS-Series Extended Warranty. On systems where the customer has paid for an
extended warranty, MJS Computer Services, LLC warrants that should the covered
system exhibit defects in material and workmanship during the extended warranty
term as measured from the original date of shipment, MJS Computer Services, LLC will
ship the customer a replacement MJS-Series product. Replacement systems may
include new, remanufactured, used parts, or some combination thereof, at MJS
Computer Services, LLC’s sole discretion. MJS Computer Services, LLC reserves the right to
substitute a newer model if the system being replaced is no longer available. Replacement
systems will carry the balance of any unused warranty. Customer will be
required to secure the value of the replacement product with a valid credit
card, and will be required to return the defective product to MJS Computer
Services, LLC within 15 days, freight prepaid, or the customer will be charged for
the replacement system. If the customer is unable to secure the value of the
replacement system with a valid credit card, the customer will be required to
ship the defective product to MJS Computer Services, LLC freight prepaid before MJS
Computer Services, LLC ships a replacement system. Customers are responsible for
properly packaging the product in original or like original packaging and for
all applicable shipping expenses for returning the product.
Limited Warranties
(d) Limited
On-Site Labor Warranty. The manufacturer warrants to the original purchaser
of all systems with included or purchased onsite warranty that should the
covered system exhibit defects in material and workmanship during the first
full year from the original date of shipment, MJS Computer Services, LLC will, at
its option, repair or replace the Product at no additional charge for parts or
and labor. If the product is located within a fifty mile radius of an
authorized service center, MJS Computer Services, LLC will provide on-site service
to repair the product at no extra charge. If the product is not eligible for
on-site service, you may return it to MJS Computer Services, LLC for repair.
Exclusions
This Limited Warranty applies to original factory configurations only.
The Manufacturer is not responsible for repairs or testing of non-covered
items. Items attached to, or installed in the computer will be removed at the
Technician's discretion prior to service.
This Limited Warranty does not cover software and disks or related
documentation. It also does not cover labor performed for configuring software
and virus detection and removal and performance of such services will be
subject to non-Warranty diagnostic and repair fees.
(e) Ninety-Day
Replacement Parts Limited Warranty. Replacement parts for system repair and
systems shipped by MJS Computer Services, LLC are warranted against defects in
materials and workmanship for ninety (90) days from date of shipment by MJS
Computer Services, LLC or until the expiration date of the original Limited Parts
and Service Warranty, as the case may be, whichever is longer.
(f) Terms of
Limited Warranties
(i) The warranties noted in sections (a), (b), (c), (d), (e) (f), (g)
and (h) do not cover damage due to external causes, including: accident, abuse,
misuse, neglect, alteration, problems with electrical power, non authorized
service, usage not in accordance with product instructions, acts of nature,
unusual temperatures or humidity, failure to perform required preventive
maintenance, improper installation and problems caused by use of parts and
components not supplied by MJS Computer Services, LLC.
(ii) The warranties noted in sections (a), (b), (c), (d), (e) (f), (g)
and (h) become effective on the original date of shipment from MJS Computer
Services, LLC, are granted to the initial customer end-user only and are
nontransferable. Removal of hardware from an MJS Computer Services, LLC system and
use of such hardware in a different system or configuration voids all
applicable limited warranties. Any claims under these warranties must be made before
the end of the applicable warranty period. During such period, if MJS Computer
Services, LLC determines that a part or system is defective in materials or
workmanship, MJS Computer Services, LLC, may at its sole discretion, replace the
system, or provide a repaired part or any part of equal or better performance.
(iii) MJS Computer Services, LLC reserves the right to substitute
functionally equivalent new or serviceable reconditioned parts and systems. MJS
Computer Services, LLC's warranty obligation is limited to repair or replacement,
either of which may be selected by MJS Computer Services, LLC at its sole
discretion.
(iv) All warranties apply only to products sold and shipped to
addresses within the United States. Warranty parts and labor may only be
obtained while the product is located in the United States.
(v) MJS Computer Services, LLC is not obligated to repair or replace
cosmetic or structural items; damage, warping or rusting of any kind to the
housing, case or frame of the product or any non-operating part, including plastic
or decorative parts; or parts normally designated to be replaced periodically
or consumed during the life of the product (i.e. batteries).
(vi) The customer is responsible for (i) the cost of defective original
parts not returned to MJS Computer Services, LLC within 15 days after the date
replacement part(s) are shipped to the customer by MJS Computer Services, LLC and
(ii) parts used for repairs not covered by this Limited Warranty. In the event
a part is not returned or is not covered by this Limited Warranty, such parts
will be invoiced at the current standard price. Payment for these invoices will
be due within thirty (30) days after the date of invoice.
(vii) The customer is responsible for the cost of defective product
damaged in shipping due to improper packaging. MJS Computer Services, LLC warrants
that its product will be properly packaged, and strongly recommends that the
customer keep the original packaging for shipping purposes. If the original
packaging is unavailable, MJS Computer Services, LLC can provide packaging at the
current rate, or the customer can work with a local shipper to provide proper
packaging. The customer can contact major shipping companies or MJS Computer
Services, LLC for established guidelines for proper shipping of components. Product
damaged during shipping due to inadequate packaging will be invoiced for the
damaged product at the current rate.
(viii) If MJS Computer Services, LLC determines, at its sole discretion,
that repair or replacement of the product covered by this Limited Warranty is
not commercially practicable, or cannot be completed in a timely manner or after
a reasonable number of attempts, then, at the sole election of MJS Computer
Services, LLC may refund the actual purchase price paid for
the covered product in lieu of further warranty obligations hereunder.
(g) Limited-Warranty
Coverage (Depot Repair). To request service, you must call MJS Computer
Services, LLC's Customer Technical Support at the number listed in your manual and
on the website based on the type of system and warranty purchased. If warranty
service is required, MJS Computer Services, LLC will issue a Return Authorization
Number (known as RMA). A replacement service is available on MJS-Series
systems not covered by a labor warranty. This service is available at the
current replacement service rate. Products must be shipped back to MJS Computer
Services, LLC in their original or equivalent packaging, shipping charges prepaid,
and the shipment insured or the customer accepts the risk of loss or damage during
shipment. The RMA number must be clearly identified on the packaging.
Any product returned without an authorization number will be returned to the
customer at their expense. Any product damaged due to inadequate packaging will
be invoiced to the customer at the current standard price. Payment for these
invoices will be due within (30) days after the date of the invoice.
Before you ship
the product(s) to MJS Computer Services, LLC, back up the data on the hard-disk
drive(s) and any other storage device(s) in the product(s). Remove any
removable media, such as diskettes, CDs, or PC Cards. MJS-Series systems
may be replaced with an equivalent system, therefore all data in the system
being returned will be lost to the user forever, if not backed up by the
customer. MJS Computer Services, LLC does not accept any liability whatsoever
for lost data or software.
MJS Computer
Services, LLC owns all parts removed from repaired products. MJS Computer Services, LLC
uses new and reconditioned parts made by various manufacturers in performing
warranty repairs and building replacement products. If MJS Computer Services, LLC
repairs or replaces a product, except as outlined in the Ninety-Day Replacement
Parts Limited Warranty above, its warranty term is not extended.
(h) Technical Support.
MJS Computer Services, LLC provides telephone set-up assistance
for a period of twenty (20) days from date of original shipment. Only products
sold on the original invoice by MJS Computer Services, LLC are covered under this
warranty. Third party products on the invoice (monitors, printers, scanners,
surge suppressors, UPS products, any custom ordered product and other
non-internal components) are covered by the warranty of the respective
manufacturer. Please consult the warranty documentation that accompanies the
respective products. Software support is not included as part of the telephone
set-up assistance program. Contact MJS Computer Services, LLC technical support at
the number listed in the user manual and on MJS Computer Services, LLC’s website based
on the type of system and warranty purchased or e-mail us at
support@mjscomputers.com within the 20
day period. Customers requesting Technical Support after the initial 20 day period
will be offered the option of a per call charge at the rate then in effect, in order
to obtain assistance.
(i) Limited
MJS-Series Extended Warranty Technical Support. MJS Computer Services, LLC will
provide telephone technical support on MJS-Series systems after 20 days from
original invoice, if the customer purchases an extended warranty. This support
will extend throughout the term purchased, (one, two or three years from date
of original shipment).
(j) Thirty Day
Money Back Guarantee. . If for any reason you are unsatisfied with your
purchase of your MJS Computer Services, LLC product, you may return the product to
MJS Computer Services, LLC within thirty (30) days from the original shipping date.
MJS Computer Services, LLC will refund your purchase price, less any restocking fee
for, including but not limited to, opened software, missing manuals, missing components,
or missing software license certificates or damage or alteration to the
product. Original and return shipping charges are not included in the Money
Back Guarantee. Returned products must be in as-new condition, and all of the
manuals, diskette(s), CD(s), power cables, and other items included with a
product must be returned with it. Failure to return your MJS Computer Services, LLC
system(s) within thirty days of shipment constitutes acceptance of these
limited warranties and all terms and conditions of the sale.
You must follow the
conditions outlined below in order to obtain your refund:
Before any return, a
Credit Return Authorization Number (RMA number) must be obtained from MJS
Computer Services,LLC by calling Customer Service at the number listed
on MJS Computer Services, LLC's website based on the type of system and
warranty purchased. This number is MJS Computer Services, LLC’s authorization for you
to return your system. The returned product must be clearly marked with the RMA
Number on the label and should be shipped in its original packaging, (prepaid
and insured by you) in order to prevent damage during shipping. You must retain
tracking numbers and all other shipping information until you have been
credited for the return by MJS Computer Services, LLC. The RMA Number is valid for
15 days from date of issue. Any product returned without valid authorization
number will be returned to the customer at their expense.
(k) General
Provisions. MJS COMPUTER SERVICES, LLC MAKES NO EXPRESS WARRANTIES OR
CONDITIONS BEYOND THOSE STATED IN THIS WARRANTY STATEMENT. MJS COMPUTER
SERVICES, LLC DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED,
INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES AND CONDITIONS OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES (OR
JURISDICTIONS) DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR CONDITIONS, SO
THIS LIMITATION MAY NOT APPLY TO YOU.
MJS COMPUTER
SERVICES, LLC'S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS LIMITED
TO REPAIR AND REPLACEMENT AS SET FORTH IN THIS WARRANTY STATEMENT. THESE
WARRANTIES GIVE YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS
WHICH VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION).
MJS COMPUTER
SERVICES, LLC DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH IN THIS
WARRANTY STATEMENT OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES,
INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR
USE OR FOR LOST DATA OR SOFTWARE.
SOME STATES (OR
JURISDICTIONS) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR
CONSEQUENTIAL DAMAGES, SO THE PRECEDING EXCLUSION OR LIMITATION MAY NOT APPLY
TO YOU.
THESE PROVISIONS
APPLY TO MJS COMPUTER SERVICES, LLC'S LIMITED WARRANTIES ONLY (ALL SECTIONS
EXCLUDING (e) AND (g). FOR PROVISIONS OF ANY SERVICE CONTRACT COVERING YOUR
SYSTEM, REFER TO THE SEPARATE SERVICE CONTRACT THAT YOU WILL RECEIVE IF
APPLICABLE.
(l) Governing
Law, Jurisdiction and Costs. THESE LIMITED WARRANTIES ARE INCORPORATED INTO
AND ARE ESSENTIAL AND MATERIAL PROVISIONS OF THE TERMS AND CONDITIONS OF SALE
OF MJS COMPUTER SERVICES, LLC'S PRODUCTS TO YOU (SALE TERMS). ALL DISPUTES ARISING OUT
OF OR RELATED TO THE LIMITED WARRANTIES SET FORTH HEREIN (CUSTOMER DISPUTES)
SHALL BE GOVERNED BY THE LAWS OF THE STATE OF WISCONSIN.
THE CUSTOMER HEREBY
CONSENTS TO THE JURISDICTION AND VENUE OF THE STATE COURTS OF WISCONSIN TO
RESOLVE ANY AND ALL CUSTOMER DISPUTES WITH MJS COMPUTER SERVICES, LLC, AND THE
CUSTOMER WAIVES ALL DEFENSES TO SUCH JURISDICTION AND VENUE INCLUDING, BUT NOT
LIMITED TO, ANY DEFENSE BASED ON INCONVENIENT FORUM.
IN THE EVENT THE
CUSTOMER AND MJS COMPUTER SERVICES, LLC ARE UNABLE TO RESOLVE ANY CUSTOMER DISPUTE,
AND ANY COLLECTION ACTION, SUIT OR OTHER JUDICIAL PROCEEDING IS COMMENCED, THE
PREVAILING PARTY IN ANY SUCH COLLECTION ACTION, SUIT OR JUDICIAL PROCEEDING
SHALL BE ENTITLED TO RECOVER ITS COSTS AND REASONABLE ATTORNEY'S FEES INCURRED.
(m) Scope
of Warranty Agreement. This writing contains the total agreement between
you and MJS Computer Services, LLC and all agreements entered into prior to or
contemporaneously with the execution of this agreement are excluded whether
oral or in writing. No oral or written information, including but not limited
to, the conditional money back guarantee, or advice given by MJS Computer
Services, LLC, its agents or employees shall create a warranty or in any way
increase the scope of this warranty.
